1. Acceptance of Terms
By accessing or using the services, programs, or materials provided by LevelUp with Nevia ("we", "us", "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our services.
2. Services
We provide digital coaching services and related educational materials. Content is for informational and educational purposes only and is not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any health-related decisions.
3. Payments and Billing
You authorize us and our payment processor to charge your selected payment method for any purchases. You are responsible for any applicable taxes. If you enroll in any recurring or subscription-based service, you agree to the stated billing cycle until you cancel in accordance with the service terms.
4. No Refunds (Digital Services)
All sales are final. Due to the digital nature of our services and immediate access to materials, we do not offer refunds or credits.
5. Eligibility (18+)
Our services are intended for individuals who are 18 years of age or older. By using our services, you represent that you meet this requirement.
6. Intellectual Property
All content, materials, and program elements we provide are owned by us or our licensors and are protected by intellectual property laws. You are granted a personal, non-transferable, non-exclusive license to access and use the materials for your individual, non-commercial use. You may not copy, share, distribute, or create derivative works without our prior written consent.
7. Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from or related to your use of our services.
9. Indemnification
You agree to indemnify, defend, and hold harmless LevelUp with Nevia and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services or violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the courts located in Ontario, Canada.
11. Changes to These Terms
We may update these Terms from time to time. Changes take effect upon posting. Your continued use of the services after changes are posted constitutes acceptance of the revised Terms.
